apartment declaration under 'aprtmnt ownership act1970'

there are14(12aprtmnts+2shops)aprtmnts in a bldg.2aprtmnts belongs to LAND-LADY(has only POSSESSION LETTER;no stamp-duty paid}other10have REgstered agrmnt.of sale.whether it is possible to register the bldg, under "Apprtmnt Ownership act1970"?is LANDLADY any way exumpted from paying stamp-duty?(her name is still there on PPTY. CARD}.kindly provide me declaration draft/forms to that effect.

Dear Ajit,
As per transfer of property act posession letter can not confirm any title any property.
Your land lady should have the title under title deeds (sale deed, gift deed ...etc...)...
If she dont have the title she can not have the right to register the said property to the others...
Please specify the who issue the possession letter and property card in the name of land lady...

dear sanjeev desai, the landlady purchased the said ppty.in 1988 ®d.it soon there-after thus her name was/is mutated in the ppty.card.in1990 she gave the ppty.on Devmnt. agrmnt.to a developer.who in turn constructed bldg.consisting 14 apartments,out of this 2apartments was given to the landlady FREE.the other 12 apartments were sold to 12 purchasers by the developer. kindly note ppty.card as on tody shows the landlady as owner.she has only possession letter from developer.hence my Queries as mentioned in my submission dted 20/4/09
