Dear mr. Bansal,
Your query is still not accurate.
However as it seems from your query is "whether a person who is going in his private car, and while travelling, he got injured, could he claim from the insurance company when the insurace policy is only third party insurance, and not comprehensive insurance?"

The answer for this query is - YES.
However, I may search for the citation, if any. But the answer is YES.

some confusion in ur quarry, but what could I understand, the occupant is not covered under third party insurance against his insurer. He has to pay extra premium to get claim in case of accident. The occupant may claim from whose he got injury.
adv. rajeev ( rajoo ) (Expert) 17 April 2009
private car occupants are injured then insurance co., will not be held responsible. they gratutious passengers. If the occupants are covered by paying extra premium then insurance co., will held liable.
