Repair work not carried out by society member.

I own a house in a CHS, about six months ago i had asked the house owner (member) staying above me to do repairs of his bathroom because my bathroom ceiling was leaking and a lot of paint and some cement had come off. The owner asked me to wait for three months as he will carty out the repair works. Now its been six months he is not willing to do any repairs citing excuses. Even after repeated reminders and intimation by society secretary has gone in vain.
Because of his delay i am not able to carry out renovation work in my bathroom and kitchen which has got damaged by this leak. What should i do?

You'll have to serve a legal notice to your landlord to get the said repair work in your house and also stating it can also be dangerous as the ceiling is not in a good state and can fall out anytime resulting in loss to life and property.

The society secretary and reminders sent (in writing) is in your favor...

As a last gentle measure visit and discuss and ask society to issue reminder in writing narrating all previous communications..

Click pictures and video to support your contentions...and submit to society...
Let society also record that your loss/damage is due to seepage from flat owner above you...

Is the condition so bad that ceiling can fall down!

You issue a legal notice to the owner that unless he carries on repair work of his bath room as a result of which your bath room is leaking and cement is coming off at the ceiling it may fall off any moment causing danger to life and limb. So request him to repair his bath room forthwith.

As the Hon. Experts have advised you may submit a written complaint to the member, with copies endorsed to the Society secretary and local Municipal Corporation. Municipal corporation is bound to take action.
