(Querist) 08 July 2014 This query is : Resolved 
Dear Experts,
in a cheating case on basis of complaint by the complainant the police has been issued a FIR but they are not taking any actions against the accused since a long time.Simply keeping quite.when ever asked to the police we will see latter.can we file a private complaint before the Magistrate stating all the details ?
2)In another case a complaint has been given to the police long back but they did not issuing the FIR.In any situation when ever the police received any complaint from a person their bounden duty to issue FIR first but in many occasions the police is not issuing FIRs .Is there any solutions for this to take necessary actions against the police through court of law?Kindly advice on the above .thank you sir in advance.

normally police may file charge sheet will take minimum 2 years, and if the police not take not new complaint, you can send register to concern police station or higher officials.

1. Yes, both complaint case and police case lie in the same cause of action.
2.File petition in court u/s 156(30 CRPC.

1. you can approach higher officials. Also can use RTI to know the progress in the FIR.

for police inaction or ineffectiveness on a complaint, an application before the concerned judicial magistrate court under the provisions of section 156(3) of cr. p.c may be filed seeking direction to the police to initiate appropriate action as per law on the complaint.
