After 97th Amendment of constitution, and PIL judgemen tof Gujarat High Court, whether section 78 of MCS Act, 1960 is valid or not ?

What are the provisions of law to invoke rmedies under section 78 to compell Deputy Registrar of Co-operative Society to appoint registrar by removal of unconstitutional managing committee ?
