Can any one provide me with the citation on the point of

Mere Demand for claiming refund of money does not create an estoppel on claiming specific performance of contract.

suit for specific performance of contract is filed and the suitor has in his correspondence all the way claimed refund of the money whatever is given to the builder and now he has filed suit for specific performance of contract and now property. Is he now estopped from claiming property. the builder has not refunded the money.
