Return of excess fees

respected sir/madam

i have paid an excess fees of rupees 84000 during my degree course.i completed my course in 2008.till date today my institute has not returned my excess fees. i gave the principal in written the details with fees receipt.. one letter each year till date today..... nothing work ...still getting a false assurance that the excess fees will be returned ...guide me

After Three years, Limitation period ends and you will not get anything. You send a Legal Notice demanding the same and file a civil suit to recover the amount, within Limitation Period.
f no acknowledgement of your Letters, you had it.
If assurance in writing, it will help you.

usually,filing of a consumer case is appropriate,which has to be done within 2 years of the cause of action.

in view of the on going correspondence,you may file a consumer complaint with a request for condonation of delay.

I guess these assurances must be in writing and all still in your possession.

If so,after passing out in 2008,there was no much reason to wait so much.

I agree with Mr.mahendrakumar that you should now not delay any more and should file consumer complaint in District Forum along with delay condonation application,i have a bonafide hope that delay would be condoned.

In suits Limitation though 03 years but NO DELAY CAN BE CONDONED and your all dues are prior to 1988.

Hence FORUM is the only best to be looked upon for any remedy,and it would prove cost and time effective too.

am suggesting you to approach your high court, before that sent a representation to your college by claiming refund of your excess fee. there will not be any response. then you can file a writ petition to direct your college to refund your money.

consumer case may take 2 or 3 years time.. but if its writ of mandamous to direct the respondent/college to repay the money mean its will disposed with in a month..

I would like to add in suggestion of Mr. Tom that for writ petition, institute shall be "STATE".
