sir i have a tenant he is my tenant from last 30 years but he also letout my property to subtenant from last 5 years but i could not take the rent against this property. should we take rent from this tenant. this is lawful or not and i want to sue on him. which section i file the case against him

Since your property is older one , it will be covered under Rent control Act. You can end the tenancy of your previous tenant on the grounds of subletting his tenanted portion to other person. If you want to keep any tenant you can accept rent from your new tenant at revised rates with an agreement of tenancy signed between you both.

You can end the tenancy of your previous tenant on the grounds of subletting his tenanted portion to other person.I AGREE WITH THIS MUCH OF OPINION OF Dr Anil Kumar Singh .AND WANT TO ADD THAT IF YOUR BUILDING IS REGULATED BY ANY RENT CONTROL ACT OF A STATE YOU MIGHT NOT BE HAVING RIGHT AND FREEDOM TO LET IT ON YOUR OWN AS OFTEN LETTING IS TO BE MADE TO PERSON FOR WHOM AN ORDER IS PASSED BY RENT CONTROL OFFICER.HENCE BETTER HAVE ADVISE OF A LAWYER OF STATE,WHERE PROPERTY IS SITUATE.

where are u located? each state has its own rent control act as rightly pointed out by Mr prabhakar singh .
if tenant has sub let without your permission it is ground for eviction of tenant
