Renewal of Deed

(Querist) 30 December 2010 This query is : Resolved 
Dear Sir

we had rented a office on lease basis for three years from 11.03.2008. now it will be expired on 10.03.2011. We want to extend the tennure of the said lease for another three years , so could you guide us whether we need a fresh lease or same lease can be used for further three years. and What is the procedure for fresh lease as well as renewal lease.

Mr Bhoop Singh,

The old lease deed certainly will contain the renewal clause and the conditions thereto, hence you are to be guided by the covenants in the deed. Further a renewed lease deed must be executed so that the conditions set forth in the renewal clause are adhered to. A fresh lease is required only if there are variations in terms of renewal or any other matter touching the lease agreement.

If you entere into a smple areement of renewaal accepting the same terms and conditions as was prevalent in the orginal leasse deed then it is ok. Alternatively you could also execute a fresh lease deed containing the same terms and conditions for such time as you mutually agreed.

Its better to sing an agreement stating that both parties are desirous of extending the tenure of the agreement with the same terms & conditions as mentioned in the principal agreement, or simply write a letter to the tenant to extend the tenure of the said agreement and get an acknowledgement of the receipt of that letter.

if your land lord ready to continue your tenancy mean you can.. otherwise you have to vacate as per the deed..

if your land lord ready mean no need fresh lease deed.. you can endorse with your old deed.
