Debaring my daughter from right to property after my demise

Querist : Anonymous (Querist) 19 October 2010 This query is : Resolved
Sir, I have two daughters and i am a hindu by religion. My youngest daughter got married to a muslim and i am not aware whether she got converted to Musilim. After my demise I want that my youngest should not inherit my property by staking her claim as a legal heire. Is it possible legally. What action are to be taken by me to achieve my goal. All the property was earned by me only.

If the properties are your self acquired only then you could transfer those to your younger daughter or wife or anyone you choose at any point of time by way of deed of gift.
As a gift takes effect right from the time when you execute it and thereafter the donor looses all right, title and interest over it, I would suggest you to execute a registered Will where you can give the properties to such person as you like . The Will comes into effect only after death of the person who executed the Will.

Dear Mr. Anonymous,
Mr. Devajyoti has given a very perfect legal answer to your query.
I am slightly on a different plane.
Your anger against your young daughter is quite understandable. How much humiliation and sufferings you might have undergone in the social set up is also understandable.
BUT ALL SAID AND DONE, PLEASE HAVE A CALM THINKING. CURRENTLY ANGER IS RULING YOU AS THE YOUNGSTER'S YOUTHFULNESS WAS DRIVING HER. I AM SURE, BOTH OF YOU MIGHT NOT HAVE WISHED ANYTHING BUT THE GOOD AND WELL BEING OF EACH OTHER. Only the surrounding society pressure is making you think in these terms. There are worst fellows in Hindu community and best persons in Muslim or other communities. After all, so long as your daughter has a good human being as her husband you should not bother about other things. Have the big heart and be quite considerate to your own daughter. According to me, you will be committing a bigger blunder by disowning your own daughter, than the mistake committed by her.
I shall be happy, if you could think calmly and then take a wise decision. Please do not forget there is another human being in this whole episode who is silently suffering - torn between her husband and daughter - that is your WIFE.

You can make gift or can also make a will which shall be enforceable after your demise. As the entire properties are your self-acquired so there is no problem to execute your desire.
