about my father land sold and not recived the amount

hello all,

My father had 3 acres and he sold that in the year of 1992 for 5000 rupees and the person paid 25000 in 3 installmets remaning amount is still pending and the property value now become 1.5 crores

at the time sales they are written papers and the paid amounts also on the stamp papers

now he wants us to register that land on his name(Till now registartion is not done in the registarer office)

and he is saying that he will pay 25000 now

i asked him to sale the land and share the amount equally as he paid half amount but he is threating my father

what to do on this situation please guide me

is there any registered agreement . If so there will be a time frame for execution of sale namely 3 years or a specific period.

After a lapse of 18 years he cannot get that property by threatening you.

Who is in possession of property?
if he is in possession, file a suit for ejectment and proceed.

Just now i came to know that my father recived the complete amount with in 0ne year and that was written on 100 rupees stamp papaers what to do in this situation ?

Though total sale consideration was received, unless a registered sale deed is executed in favour of the purchaser, no valid title will pass on to him. If he is in the possesiion of the land, you can file suit for recovery of possession. He lost his remedy for filing a suit for specific performance as already time is barred.

If the property is with him file a suit to recover the possession.With our registered sale deed he could not claim title.His claim over the property could not stand with the existing agreement.
In second part of your query you have written that your father received entire amount within one year.What you mean by this?If it is one year from the date of agreement then you are in safer side.
