a society is registered under Society registration Act. i am owner on the basis of sale deed of two shops. The society on the western side raised a illegal wall on the property of corporation and on the easteren side installed a gates illegally on the land of municipal corporation ludhiana. if i wish to remove those gates and wall then what remedy i have. i have no concern with those wall and gates only my ingress and egress has become difficult. if i filed civil suit then court may ask under which capacity and right you have filed the suit

U r member of society. If u hv problem of ingress n egress first complaint to society. If they ignored address ur complaint to Registrar of SOC. If no result, write to corporation that wall raised n gate constructed is within corporation land. They will take prompt note n pull down wall n gate n u have ur smooth access.

First of all make representation to Corporation seeking removal of illegal encroachment failing which file criminal complaint before SDM Ludhiana under section 133 of Criminal Procedure Code as well as civil suit with one another person under section 91 of CPC after obtaining the permission of the court.
