dear Experts,
If a person given a cheque which was bounced due to Account Closed ,
Whether i have to file a case directly in the Magistrate court OR hav to give complaint to the Station House Office (Police )generally U/s 420 cases we have to file a complaint before the police first.kindly advice in this regard.Thank you.

this is cheque bouncing case and matter is related to recovery of money so police have no role in this regard first of all send a legal notice to him if he is not ready to pay the amount within 15 days then file a complaint before magistrate.

For complaint case in court, you need not file any complaint with Police.

You should first him with a mandatory notice demanding him to pay the cheque amount by allowing him 15 days time to facilitate him to pay you the same, if he fails to comply or fails to reply or his reply is not satisfactory, you may approach your jurisdictional court of JMFC to file a cheque bounce case against him. It is not that you cannot approach local police with a criminal complaint u/s 420 IPC against him, but that may not be very effective and you cannot rely upon the police expecting them to initiate proper action to recover the amount.
