i want to file a claim petition under M.V. Act actually i am facing problem , that who is owner of vehicle as per police version affidavit of purchase shows A is owner , but as per R.C. owner is another person who is B , and in Insurance policy the name of B is appearing , A has relased the vehicle from court as show him owner of vehicle . who is my respondent as owner , A or B , if A then insruance will not liable because A has not transferred the vehicle in his name nor insurance policy , what can i do now. Who is my respondent.

make all of them party in your claim petition the burden of proof lies upon them to prove their innocence.

First implead the present owner as necessary party, if the Insurance company objects or repudiates the claim, then take steps to implead the erstwhile owner of the vehicle as necessary party.
