Renistatement with consequential benefit

Sir,

One of my friend has been reinstated in government service by Hon'ble CAT,PB,Delhi.the order as follows.

"the applicant is reinstated in service with consequential benefits of seniority, pay fixation and promotion. He will, however, not be paid back wages for the period he has not actually worked."

my question is wheather he is eligble for EL and HPL for the termination period or not.

Kindly suggest me.

One of my friend who was terminated from government job under CCS Rule 5 has been reinstated in government service by Hon'ble CAT,PB,Delhi.the order as follows.

"the applicant is reinstated in service with consequential benefits of seniority, pay fixation and promotion. He will, however, not be paid back wages for the period he has not actually worked."

my question is wheather he is eligble for EL and HPL for the termination period or not.

Unless the period falling between the date of termination and reinstatement by court order is regulated as duty period by issue of specific order to that effect, he would not earn leave of any kind.

I agree with Mr. Dingra on this issue that unless he has been recognized to qualify the intermittent period, he may not be eligible for having earned leave.
