Bank money withdrawl by spouse

I am helping a 75 yrs old man-

his wife 72 yrs old died 10 days ago, in her a/c 50,000 money is left. No nominee is mentioned in Docs. Their 03 sons (all above 25 and all gov servant) are separate from last 15 yrs. Canera Bank is not giving money to husband and saying that he should take clearance and come in bank with his sons. father well knows that the sons will not support him. This money is blood of husband and he need it urgent. he is hungry. bank manager is not supporting.

Father is army retired and old lady was victim of their Daughter-in-law and son's cruelty.

please advice what to do...?

Dear Mr. Jaswant,

All said and done, the Bank Manager is right. You and I also would do the same thing if we happened to be the Bank Manager.

Now, since there was no nominee in the case, there is no other go. Normally one has to obtain 'succession certificate'. However, in this case, since the amount is less, the Bank Manager would be willing to release the amount provided all the four i.e. The husband of the deceased and her three sons approach the bank for closure of the account and release of the amount to them. PLEASE TAKE IT, THE HUSBAND HAS NO OTHER GO, THAN TO GIVE AWAY THE EQUAL SHARE i.e. Rs. 12,500/- to each of the sons. If the father is not willing to give, then he can never get even a single penny.

Yadi father apne sons ko ' BADAKHAL ' dikha de, to kya mil sakta hai.

No, the documents specified by the RBI has to be completed and submitted in absence of nominee. His sons may relinquish their rights on the prescribed stamped documents.
