This query is : Resolved
the property belonged to my grand father which is ancestral. my father studied 9th class but in the registered document thumb impression is there and two witness are signed the document year was 1978 ,my father and witness were died.present i am in the possession ,but they are filed a civil suit.we are two brothers and sisters.
1.present we want to prove that my father thumb impression is not genuine (correct).
2.how to dispute the document and how to cancel the document .
3.what type of witness we required.
pls advise me sir,

In absence other admitted thumb impression of your father, his thumb impression in the deed is difficult to disprove.
Now if the deed is indeed genuine, we can not give immoral advice to cancel it.

Send the document to Forensic experts and if it is not genuine , you can apply in appropriate court for its cancellation. You have stated that your father had studied
upto 9th class then if the deed in question
only bears his alleged thumb impression but not any signature then it is an invalid deed
for want of incomplete execution.
Even if you father's admitted thumb impressions are not available for comparison with disputed one,and deed does not bear signature of your father,then you need to plead and prove that your father was a literate person(file his schooling record upto 9th class)and could read and write and sign,you would be able to sail your boat this way.

if i send the document to forensic expert how it is compared with other thumb impressions .father had died but his
thumb impression is not genuine addition to this we are in possession.

You did not disclose if the document in question is signed by your father or not and if not do you have proof of his education?

Dear Client,
The registration officer may be having a specimen thumb impression of your late father.Also, if you could show that you've been in continuous,uninterrupted enjoyment of the property in question, for a period of 12 years or more, your title gets perfected by virtue of the doctrine of adverse possession. If that is not the case, there is very little hope of your succeeding in your designs of proving it being not genuine.

1.we have a education proofs of my father but how this is useful to my case ,we want to dispute our father thumb impression perfectly it not our father thumb impression but how to prove sir.

we are in possession it is clear madam but how it is proved by the documents and for adverse possession what type of documents or records are required from mro office madam.

If you have proof your father was educated and literate and used to know how to sign
then make one mercy more upon me for your own good whether the document in question bears only his alleged thumb impression or
also a signature of your father?

I disagree with whole world who plead execution complete by a person who is literate and able to sign but have not signed the document and there is no endorsement on the document why he did not sign and put his thumb impression only.Okay dear SIR Abdul Razique ???????????????

but how the genuity of the document proved by purchaser legally .my father not involved in the document but my relatives created the document and saled the property which was recently known the matter .
how the opposite party prove the document is original one.

As advised by the experts, best way is to search the accepted thumb impression of your father. May be he purchased / sold / witnessed purchase sale some other property. The registration authority gets the thumb impression of all the parties along with the signature. You have to search such documents.

if you think the sale deed is false and fabricated then you challenge the deed in court with have sufficient documents by which you stand a strong prima facie.
