Dear Sir,
My father owned a pagdi system shop in Mumbai & had two sons me & my younger brother.
The rent receipt of said shop was on three name i.e. 1) my father 2) myself 3) my brother.(I don’t have the copy of the rent receipt)
After the death of my father my brother had transferred the said shop on his name (3-4 years back) after offering some money to landlord. After transferring the shop landlord died & 1.5 years back my brother also died.(currently the shop in under his wife’s possession & she has given the same on rent)
Now the legal heirs of the above landlord has sold the building to a trust for redevelopment purpose & said shop is under redevelopment scheme & new landlord has submitted all the documents in MHADA on my younger brothers name.
I have approached the new landlord & told them all the stories (also submitted the death certificate of my father & brother & Shop & Establishment License for last 30 years, which I had obtained from Municipal Corporation under RTI application), after listening all these thing, new landlord has again submitted application in MHADA & MHADA has removed the name of my brother from Occupant list of the said building, his name appears as a tenant only & in occupant list they had written “in Abeyance”.
Now the current landlord are insisting to put both of us name (i.e. my name & my brother’s wife name) in “occupant”, I am ready for the same but by brother’s wife is refusing the same & she want her name only & don’t want to give my share. They had tried very hard to convince her but they are unable to do the same.
Due to this consent procedure for the redevelopment is also halted…
What to do in this scenario, please help.

try to obtain evidence of earlier rent receipts in joint names of your father and the sons . your fortunate that new landlord was considerate and has agreed to transfer the shop in joint names .
tell the landlord to go ahead and insert both he names . if your sister in law is aggrieved let her move court

Old records of your father or the landlord can be searched.
