Return of dowry

(Querist) 09 August 2013 This query is : Resolved
Sir my wife went to Crime Against Women Cell for taking back the dowry given in marriage. When I went to CAW cell for returning the dowry goods she refused to take the dowry goods and asked for 15 lakhs as compensation. She gave her written statement in CAW cell that she will take the dowry goods back in the Tis Hazari Court where I have filed the divorce case.

Can I submit the dowry goods given by my in laws in local police station before the judge ask me to return the dowry goods in court?

Regards,
Rakesh

You will hv to hand over in Police station where she will complain.
You may issue her notice to take away her gold/ belongings, or offer to deliver to her home, before she complain to Police. It can save you from 498A partially.

Sir my wife has already made complaint in local police station where her complaint has been complaint has been rejected as we had proof that we never demanded dowry, and never physically or mentally harassed her. She has also made compliant in CAW Cell. But she is not ready to take back her stree dhan. Can we ourselves handover the stree dhan in CAW cell or local police station.

My wife says that she will take her stree dhan in court.

Do not over react.
Send a notice to her asking to take her stridhan.
You can lodge such complaint in police station as well.

Agree with the experts, nothing more to add.

Yes. in the trial court, you can file an application showing your willingness to return the stri-dhan(not refer them as dowry articles) and pray the court to direct her to receive them. If she refuses to accept them, you will be in good position from any frivolous petitions she may file in this respect.
