Buying of property

(Querist) 22 April 2013 This query is : Resolved 
Sir
i am buying a property(land and building)and i am the 4th buyer.
The original title deed of 3rd seller is available.
but the title deed original for 2nd and 1 st is not available.
The third buyer has lost all previous original deed.
third buyer bought in 2005
second buyer bought in 1992(missing deed)
first buyer bought in 1983.
possession is with 3rd buyer.
What should i do now and should i go ahead with purchase.
What precuation should be taken.

Dear Manoj,
You collect all land records and hand over to Advocate for obtaining Title and Search reports. Let the subject land have number of transactions, the Advocate will do the needful search in the Office of Sub-registrar and he will give a proper report for Marketable clear Title.

dont purchase the property under any circumstances . original chain of title is lost . you will find great difficulty in obatining bank loan for purchase of property

As per advocate he has adviced as:-
affidavit from 2nd seller.
witness of 2nd seller in my registration.
police fir
publish in 2 news paper and wait for 15 days
worst senerio is 2nd seller has mortaged it.
Kindly advice.
Latest title deed is available in original.

Despite of the factual position told by you, it shall be better to obtain the certified copies of the title deeds of the previous owners qua the property in question and a detailed search report with the affidavit of the second owner and first owner, if possible should also be obtained.

Also enquire from the banker about their any other specific requirement in this regard so that the desired document may also be got prepared.
