Hi, I am a resident of New Delhi residing with my family and my mother at our encestoral house. My father expired 2 years ago. Our house which is in the name of my father is not a free hold property. Now, me & my 2 sisters have decided to get the property transferred into my mothers name. Apart from the property, we also own 2 cars which are also in my fathers name.
I wanted to know the legal procedure of getting the property and the vehicles transferred in my mothers name. I have also spoken to some agents who deal in such cases and all of them have advised me to go in for Relinquished Deed. Pls suggest is that the correct path we are following.

Every one of you should give relinquishment deed in favor of your mother.

Thanks. The relenquishment deed format shared with me does no where talk about the vehicle. Will there be a separate document for that or lines regarding vehicle will be added in the same deed.

relinquishment deed needs to be signed by legal heirs in favour of mother .

for vehicle the transfer has to happen via the RTO.
Visit the RTO to get the same effected.

Relinquishment deed should contain the matter of the house as well as of the vehicles so that its copy may be enclosed by your mother while applying for the transfer of the ownership in her name.

Both options are open.
A relinquishment registered deed for house.
And a no objection affidavit addressed to RTO for transfer of motor cars may save few bucks on stamp duty front.
