Referring matter to mediation

(Querist) 03 February 2012 This query is : Resolved
Respected experts, I want to know whether a matter can get referred to mediation center before filing of DV petition? Whether both the parties have to agree for the same or even single party can pray for it?
Devajyoti Barman (Expert) 03 February 2012
The court can not do so.
However the Protection Officer may call for presence of husband for mediation.

Without consent for both parties no mediation can happen.

NO MEDITATION CAN TAKE PLACE WITHOUT MUTUAL CONSENT OF PARTIES.

I have similar opinion as Mr.Prabhakar Singh.
Raj Kumar Makkad (Expert) 03 February 2012
Legal Services Authority Act has given ample power to courts to call both parties before mediation centre even before filing any litigation but the consent of both parties is must for that purpose.
