Querist : Anonymous (Querist) 18 January 2012 This query is : Resolved
in the given case the date specified in the preamble is different than the date specified in the contract about the delivery of products. so which of the two is binding?
H.M.Patnaik (Expert) 19 January 2012
if the contract suffers from errors apparent on the body itself , the date can be determined mutually by the parties to the contract taking in to account their actual intention at the time of entering in to the Contract or else the the Arbitrator/ Court will decide the same by examining the language of the contract .
Raj Kumar Makkad (Expert) 19 January 2012
The date mentioned in the contract shall prevail over the date mentioned on preamble.
Sailesh Kumar Shah (Expert) 19 January 2012
Both ld. Experts rightly explained.
Devajyoti Barman (Expert) 19 January 2012
The meaning is to be determined from reading the whole contract.
No piecemeal interpretation would do.
