Querist : Anonymous (Querist) 25 December 2011 This query is : Resolved
Sir
Plaintiff want to add some more people under U/o 1 rule 10 in civil suit. As I made objection that single person can't initiate such type of suit individually.
What is the provision? Is court bound to allow more persons?
Dayananda Gowda (Expert) 25 December 2011
plaintiff has a liberty to add more person as defendant. You have not Staten the nature of suit. But As per the provision of O 1 R 10, who are the necessary to proper adjudication of the dispute and the presence of the parties are necessary, court may allow such person to contest the matter. If the proposed applicant are not necessary for the solve the dispute the court may reject such application.

You state that as "I made objection that single person can't initiate such type of suit individually."
But you do not state what kind of the suit is???????????
Is it representative suit for some public right?????????????
Devajyoti Barman (Expert) 28 December 2011
What is the ground of your objection?
If there is joinder of cause of action then a representative suit could be filed by the plaintiff where the others are not required to be dded.
