is that 408 IPC is applicable for students to their institution ? Liability by students to the institution is include in witch section ?

sec 408 is Applicable to employee, a paid servant.
You being Student, it is not included.

Section 408 aptly clear. it is not cover to student.
408. Criminal breach of trust by clerk or servant Whoever, being clerk or servant or employed as a clerk or servant, and being in any manner entrusted in such capacity with property, or with any dominion over property, commits criminal breach of trust in respect of that property, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Only if the student is also working as an employee in that institution and he is found guilty of criminal breach of trust.

If the student has some other responsibility, which allows him to deal with the property of the institution then 408 would be applicable.

Situation is ... my Friend took admission in an Airport management coaching institution after few days he change to another institution for same course ... his friends called him and ask about why he is changed ... he replayed that institution is not so good... new one is better .. unfortunately the call was taped by the CEO of the institution .. now they threatening by this sec IPC 408..
