Dear All,
I am uncertain regarding a problem which I am facing as of this moment.
My brother is going purchase a flat which is clear and free from all encumbrances from a London based NRI. Now, being a NRI, he stays in London and naturally he needs to give a specific Power of Attorney to a particular Individual in India, who shall receive the consideration money from us and execute the Registration process.
Now, my Qs. is how a person shall register the Specific POA in London or in case in India, when both Principle and authorised agent are staying at two different places.
Also please note that the NRI staying in London is not in a position to come to India.
I would request the Experts to provide their valuable comments.

NRI can execute POA in London, UK and is valid in India.
Once he send his POA, you can register it in India, and act upon it.
NRI need not come to India.

Corectly advised, such PoA should be validated by Indian High COmmission or Embassy too.

I add some more in the installed intimation provided by Shroff and Kapoor that such POA got executed by seller duly got verified by High commission of India in UK shall also require registration with the local registrar by the person in whose favour such POA has been sent and only after registration such POA holder shall become a competent person to represent the seller NRI.

If the principal stays in abroad and the agent stays in India, the person in abroad can execute a POA notarised in UK and attested in Consulate in London.
Thereafter it needs to be adjudicated in India.

Do follow:-
1.Power of attorney has to be typed on a plain paper;
2.Get authenticated by the Indian Embassy ;
3.when it comes back, it has to be produced before the collector for adjudication u/s Sec. 18.
