Party in person

Querist : Anonymous (Querist) 10 November 2011 This query is : Resolved
Can family court judge harass a party in person with teasing remarks.. such as "you have to purchase peace otherwise you will become pieces"

on every hearing the judge pass over the matter and calls as a last case at the end of the day making the husband loose leaves in the employment,

and further the judge is not entertaining any interlocutory application of husband and not even ordering notice in the IA filed by him.

what is the remedy, can the same be used for trasnferring the case to a different court. husband feels indirect pressure to compromise the matter.

it would be better transfer the case by moving application before DJ.

A complaint may be lodged against the Judge before Chief Justice of your concerned High Court.

1. Judge can not decline any application, he can reject it though/ for that in every court, there is a box to put applications.

2. Though you can apply for transfer of Judge, but such applications need very solid grounds.

I myself have been discriminated against by a particular presiding officer and found putting applications in box better than fighting a new case.

OK Shonee ji, your voice is reverberating everywhere at times becoming an authority in itself. Sadly There is no such box to drop application ultimately the judge has to order notice which she didnt.

I dont want to file transfer petition as I am conscious that it is counter productive.

The option is to make application for transfer of the case before High Court. A family Court Judge is not sub-ordinate to District Judge. Sometime senior officers from the rank of District Judge are appointed as Family Court Judge.

Regarding putting applications in Box,I say that this system is not prevalent in all over Indian Courts. In West Bengal too there is no box system but in Jharkhand I saw this Box System.
