Withdrawl of application for stay.

I have a question if some one can advise.
We were traped in dowery case ...totally fake.
we have bailes for that case, and applied for stay in allahabad high court.in 2008,
now through some mediator settlement is being considered. I want to know how can we withdraw our application for stay , so that that case can be taken back by opposite party.

In high court there is no way that we will get any c=date soon.

please explain facts of your case .from the vailable facts mentioned by you the follwing course of action is recommended


first agree to consent terms . get them drafted by some local lawyer . on the basis of settlement arrived at you can make application to court that you are not pressing for any interim reliefs ie stay of proceedings .

we have drafted the consent term that we pay that party 6 lakhs once final hearing for divorce happens and they take their case back , divorce case is going on in Haridwar court and we have deposited draft of 6 laks with the court.

Now we are waiting for allhabad high court for either sending that case(application for stay) back to lower court ,where opposite party can take their case back or high court itself dissmisses the case on the basis settlement documents.

I have question regarding how do we expediet the hearing as it has been 6 months we are trying to get things done but every time there is new date,Even though it is not for stay any more and is just for withdrawl of "application for stay".

No need to withdraw the stay.

In fact other party can not withdraw this case.

Just get it converted into quash petition based on compromise.
