Succession certificate

my father died recently . he had some debt in a state government corporation . to release the payment state government corporation is asking for succession certificate. I have a family of
1. my mother
2. one minor brother
3. and one married sister
can i get the succession certificate only in the name of my mother.

All of you are the legal heirs and therefore you cannot give only your mother's name as successor. That will be a false claim / statement. You have to therefore give everyone's name. However, obtaining such a succession certificate, everyone has to give a No objection certificate stating that you have no objection if the amount falling to your share is paid to your mother.

The Succession Certificate and Legal Heirs are different kind,if your father died intestate without mentioned any nominee in any debts and securities then you require a Succession certificate granting by the Court,where your mother can file an application and others have to file no objection.

my problem is that the state government corporation will not give payment in case of multiple names in succession certificate ( we all known how government office work)
another thing
what about minor brother as will he be able to give no objection in succession certificate

It is State Government Corporation who are asking succession certificate in name of my mother.

You might have wanted the money to be released in favour of your mother and consequently they might have asked for succession certificate.

No organization, whether it is State Government, Corporation, or private, can ever say that you bring the Succession Certificate in the name of so and so.

All it will say or ask is that get the succession certificate. That is all.
