Dear Sir/Madam

Sir, My name is J. Srinivas as i am practising as junior advocate. Sir, i have doubt regarding GPA (General Power of Attorny),if the person has given GPA to another person for the period of 5 years and if he wants to cancel that GPA, what will be the process to cancel the GPA. If the GPA owner is not willing to cancel that, what the steps i need to follow the for cancellation of that particular GPA.

POA is valid until execution of the purpose it is executed for or until death of the principal or the agent. In your case the POA is given for 5 yrs and the details are unclear, it is a PECULIAR CASE AS TO WHY THE POA WAS EXECUTED FOR A PERIOD OF 5YRS. If the limit of time has passed 5 yrs then the POA stands cancelled automatically.

It may be canceled or revoked through general publication in news paper or govt. gazette.

In your case, agent wants to get POA cancelled. It is very easy process. Give notice to Principal regarding the intension of agent and tell him that agent deems himself free from such POA henceforth and this notice should be widely published so that the purpose of the agent may be fulfilled. Principal cannot take any undue benefit even if he do not practically/legally gets cancelled such POA even after making request by agent.

The principal can cancel the POA before 5 years if the POA was relating to the activities of the Principal only and no interest of the agent was involved with the POA. The procedure for cancellation is same like that of the execution.

A power of Attorney can be cancelled at any time by giving public notice.
