Recent Supreme Court decision allows Unregistered sale agreement as evidence in Court in specific performance case. Does this mean it allows exemption from paying deficit stamp paper charges and penalty throughout the case. Please clarify

The unregistered sale agreement can be used as evidence alone but not enforceable hence there's no necessity to pay stamp duty.

When plaintiff asks the Court to register the property in his name as per sale agreement still not necessary to pay stamp duty

The plaintiff in a suit for specific performance of contract will seek court to direct the defendant to execute the registered sale deed failing which the court to execute the registered sale deed, hence the plaintiff cannot ask the court to execute a registered sale agreement. You may first understand that what is the subject that you want to clarify here instead of seeking clarifications over illegal aspects.

It is not necessary (except in some States) that an agreement for sale be registered. However, it should be stamp paper as specified by the State Government. Else, in an action for specific performance, deficit stamp duty as well the fine, as specified, needs to be remitted.

Although unregistered sale agreement is admissible in evidence but unstamped or insufficiently stamped sale agreement is not admissible in evidence in case of specific peformance of contract however if compliance of sec 35 of Stamp Act is fulfilled by paying deficit stamp duty and penalty then agreement may be admissible in evidence.

Registration of "Agreement to Sell" and payment of Stamp Duty are governed by two different Acts/Laws ?
Unregistered agreement can be used to prove the case, however, it has to be properly stamped and valid.
