Land occupied by central govt.

Our lands(large extents) were occupied by central governament organisation and buildings are constructed and some land is lying vacant. This is more than Ac.150 ( Occupied much before Agricultural land Ceiling came in to effect , ie Befoe 1973 and is in Telanga State). Can we ask for Compensation Now! If yes, who/ and how to go about this issue.

As per the Land Ceiling Act, 1976 of the Combined State of AP, when the land is identified as excess land, the authority concerned issues notices to the parties concerned that the excess land will be handed over to the government, and compensation as per norms will be given. The affected persons shall submit their consent or objection. However, you cannot claim now, after a gap of roughly 50 years.

What were you doing all these 50 years, if it was your grandfather's property then whether the property devolved on his legal heirs after his lifetime if so they only have to take any action, whereas now it appears to be barred by limitation, however you may consult a local advocate and proceed as suggested

Time barred claim shall fall flat. Lot of waters have flown in Ganga since 1973.
Land is a State subject
It is better to seek professional services of a local prudent lawyer for proper analyses of facts/documents and necessary advise/ proceeding.

As pointed out by Dr. J C Vashista, every State has its own Legislation on Land Acquisition, but here the land is acquired by the Central Government for a public purpose. The core question is under what law the central government acquired the land, did the central government comply with all the procedural aspects of land acquisition, such as preliminary Notification of land acquisition, etc? File RTI before the District Collector of your District, asking for the Central Gazette Notification in acquiring your land, whether claims and objections from landowners were notified or not through the newspaper, and under what law the land was acquired. Yes, it is a belated issue of 50 years old, but it is a continuing injury, and unless you collect all the above information, it will be difficult to respond to your query.
1. Under what law does the Central Government acquire the land?
2. Whether landowners were informed by notification, including newspaper publications?
3. Whether a survey of land was carried out?
4. Were claims and objections from landowners conducted or not?
5. Whether the Central Gazette notification of land acquisition was published or not? These are a few core issues to be clarified.

Has the Government authority has not followed the due process of law, you can initiate civil action or approach the High Court in a Writ Petition.

Dr.J.C.Vashista, land is one subject in which I have seen the high handedness of the Government, be it Central or State in exercising the Eminent Power of the State. Even communist Countries like China and Russia do not act the way our government does.
