Advance notice posted before suits

Sir,
I have case state commission consumer court against Rajasthan housing board but notice posted before suits 10 months but RHB says give notice before 6 months
So suggest what we do

For filing a consumer complaint case under section 12 of the Consumer Protection Act notice is neither compulsory nor mandatory.
