my brother lost case in sec 138 for blank cheque . nkw he is not havong capacity to pay the amount .. how to get rescue

If cheque issued, liability cannot be ignored. Even otherwise also, you have not discussed about background history of the case, on account of which your very short message indicates, as if it is an academic query.

If your brother is not having the capacity to pay, he shall have to face the consequences mentioned in the same judgment passed by the trial court.

He can be sent to jail if he fail to comply court orders.
