Great grand father property

(Querist) 23 March 2015 This query is : Resolved
First Generation
----------------
My Great Grand father 'A ' purchased a property in year 1901.

Second Generation
-----------------
A had only one son 'B '

Third generation
-----------------
B had three son called C ,D and E.
Now D and E died.

forth generation
----------------
C has one son , D had two sons and E had 3
sons.

Now if the property is sold now . will the sales proceeds will equally be distributed between C and two sons of D and three sons of E.as the distribution is being made in fourth generation.

Presuming that there are no other surviving legal heirs C will get 1/3rd, two sons of D together can get 1/3rd and three sons of E together can get 1/3rd share.

However the query appears to be academic.

Will the position be same if we are goverened
by Mitakshara law of hindus.
Devajyoti Barman (Expert) 23 March 2015
yes, the property will be divided in the manner as stated above.
Rajendra K Goyal (Expert) 23 March 2015
It is supposed that the family is Hindu and no other legal heirs (i.e. wife of D&E or any daughter) are alive / present.

C would get 1/3. sons of D would get 1/6 each, sons of E would get 1/9 each.

Basically B's property will be divided in to three parts, out of which one part to C, second part to D's children, third part to E's children equally.

A very good examination question set for the learned experts by the author, Ajay Kumar, which is prima facie pure academic query.
Whatsoever, answer appears to be on the right (correct), isn't it Ajay Kumar? How many marks did you award to the individual examinee/ learned expert?
