Dear Sir,
I want your valuable advise on below enquiry.

This happened on 23rd Oct a car hit our car standing idle on road side. The owner/driver of the car agreed to pay whatever the expenses to get repair our car but after Diwali.

Now he is refusing/ignoring and paying Rs. 500/- however the tentative expense is about 15k to 20k

Kindly advise how can we proceed. Can we loge FIR after 4-5 days.?

1. Yes, you can file F.I.R. even after four or five days. Do not move your vehicle from the place it was stationed at the time of the accident.

Sir, vehicle has been removed the accident sight. Because initially it was assumed to be settled amicably.

Do we need witness to file F.I.R? Please advise steps to proceed.

You can lodge your claim with Insurance company.

FIR can be lodged but what you shall gain will be much less than you will require to spend, reconsider and ust digest the damage.

Lodge a criminal complaint against the person who cause the damage and get the FIR registered. Along with the copy of fir, you may claim insurance for the damages.

For Claiming Insurance Amount up to Rs.20000/- FIR not required.Post the Application accordingly to Suit the Insurance.

any authorities, as Insurance co & court demands Police Comp/ FIR as evidence of accident to third party.
