Mr. Patil it is totally a vague query.

all depends upon the facts and circumstances of the case, the entire evidence has to be appreciated before making any decision.

the offence has to be proved beyond reasonable doubt and certainly if there are two opinions in a case then the one which favours the accused must be upheld.
