Estoppel

(Querist) 07 July 2014 This query is : Resolved 
A person ,being aggrieved by an official act,sought sanction to prosecute the officer.After many attempts,he failed.
Then he filed complaint directly in the criminal court.Can the officer take the defense under principle of estoppel so as to get person's complaint quashed?
