Huf property

Hello,

My father has bought a property in UP under HUF but the same is registered in his own name. Now he say this property belongs to him and he will sell and want to leave my mother also. We are two sisters one is married am myself single .Do i and my mother have any right in that property.

Kindly Advise.....

Yes for which you have to file a suit for partition and injunction.

Anybody and everybody can file a suit. But one should know whether they have any legal basis for their claim before venturing to file a suit.
Pl. indicate what documentary proof that you have to show that it was an HUF property?

I have copy of ITR (HUF)where he has mentioned that property as asset.
One more thing i would like to mention . muy self got married and now my status is single. do in such situation can i claim my share in such property.

If you are able to establish that the property purchased in the name of your father is HUF property, no doubt, you are also the co-owners.

You can get share if it is established that the property is joint Hindu Family property.
