Evidence posted case

(Querist) 01 March 2014 This query is : Resolved
civil suit is posted for evidence due to ill health I could not attend court I am party in person.
1- will the court give next date in my absence.
2- is there any loss if I do not attend.
prabhakar singh (Expert) 01 March 2014
An adornment application is required with medical certificate to support ground of illness else the court has two options:
1)To dismiss the suit if you are plaintiff or to proceed exparte if you are defendant.
or
2)To decide the case on merit.

Hence loss on absence may be accordingly calculated by you as in case 1: restoration would lie but in case 2: only appeal would lie.
