Q) my wife has filed domestic voilence case in punjab 2yrs back in cjm court the judge is lady and she favours my wife. Even in deciding interim relief she did not consider my liabilities. Can i shift this dv case to higher court i.e session court? If yes what is the procedure
Adv Archana Deshmukh (Expert) 03 June 2013
You cannot transfer the case to the sessions court. The jurisdiction of the court cannot be changed as such. If you are dissatisfied with the orders then, you can challange the order in the sessions court.

case cannot be transferred . there is no question of fabour tism by the judge . if you are aggrived by interim orders passed by judge go in appeal against said order

This is wrong to have such attitude which you have posted about the judge. The trial court is not final authority. There is the judicial system of filing appeal against the order which you deem fit is not passed as per law and facts.
