Stamp duty

An Agreement to sale was executed in Delhi with regard to an Apartment (Immovable Property )in NOIDA.
Now the query is with regard to Stamp Duty.

1.Can an Agreement to sale be made on Rs. 100/- stamp paper.

2. From where the stamp paper has to be purchased, i.e. from U.P. or Delhi ?

3. Who will be liable to pay that ?

liabilty to pay stamp duty depends upon agreement between parties .

stamp duty has to be prucahsed in Up since property is in Noida .

as per stamp dty rates prevalent in Up document will have to be stamped .

1. no, it would be paid on 4% of half of Sale Consideration.

2.Noida,UP.

3.Buyer as per Section 29 of Indian Stamp Act,1899.
