Content of chargesheet.

Querist : Anonymous (Querist) 22 January 2012 This query is : Resolved
if content of chargesheet is vauge and does not provide details of time and place of alleged crime.
How can husband request detail investigation report other than cross exaimnation.
V R SHROFF (Expert) 22 January 2012
if content of charge sheet is vague, apply Discharge.
is it not included with charge-sheet????
Cross Exam is part of trial.
Discharge ends the matter, no further trial, so no cross.

You may apply for quashing of FIR in the given facts and if do not wish to do so then the entire benefit of lacunae shall go in favour of accused.
Devajyoti Barman (Expert) 23 January 2012
Any defect in charge sheet does not give ay right to the accused for relief.

The charge sheet is mere prima facie report after completion of investigation. It does not prove guilt of the accused person.
Querist : Anonymous (Querist) 23 January 2012
if chargesheet is suppose to be just complination of wife and her parents statement. They why would it take IO to file chargesheet 1 year after intial complaint.
We can start the trial process based on complaint instead of chargehseet.
Deepak Nair (Expert) 23 January 2012
If the charge sheet is vague, then it is weak. That will be an advantage for you to get discharge in this case or acquital. No need to ask for a re-investigation.

Do as adivsed by the experts above.
Prabodh Shukla (Expert) 23 January 2012
dnt wait rush to HC for quashing (quashing of charge sheet) dnt go for discharge .......

Try quash, discharge step wise even if you fail ultimately at trial it would result as beneficial to you as accused; the more the lacuna the more the chances of acquittal.
