Esi registration

(Querist) 02 September 2011 This query is : Resolved 
We un'stand that ESI registration is compulsory if the number of employees is 10/20 as the case may (using power or not)

Now the clarification required is..
if the manufacturing company having employees over 20; but where all the employees are drawing over Rs.15000/- a month, which is the prescribed limit by the act.

Now does it required to be registered since there is no contribution either from the employee or from the employer..

Pl. advise and comment.

Dear Visu,

The existing wage-limit for coverage under the Act, is Rs.15,000/- per month (with effect from 01.05.2010).

So, if all the employees of an organisation are drawing wages of more than Rs.15,000/- p.m., there is no need for registration.

In the case you automatically bind to open PF a/c with the local Pf commissioner/office and in that the employee and employer's contribution is mandatory under the PF Act.
However the employer himself can switch to PPF,if its a proprietor/partnership firm.

Girish! Here matter being discussed is of ESI and not of EPF.

It is option for the employer to get his institution covered under ESI Act as on the day of 01.05.2010, all employees were drawing the wages over the prescribed limit of coverage.
