Only in a court you can compromise as if you compromise outside the court the case cant windup.

A motor accident has two facts, one is the commission of criminal offence and the other is compensation claim. The person responsible for causing the accident by negligent driving is liable to be booked for criminal offence, further liable to pay compensation to the victim. However, if the vehicle is insured, insurance company will pay.

In my openion, there is no need for compromise if the said vehicle was insured at the time of accident .Let them come into the Motor accident claim tribunal .
If the vehicle was not insured,do the compromise under the supervision of any expert and in to the court only .

i agree with all ,with one court compromise will sum up the case finally hence if you feel it would be you to pay, compromise in court is a better bet.
