Plz help........ Love merriage..

Querist : Anonymous (Querist) 28 May 2011 This query is : Resolved
Hi i am a 19 year old hindu guy..my girlfriend is also 19..but her family is pressurizing her for merriage to some other guy as they are against love marriage but we want to marry each other so how could i marry her? Can i marry her whn i m 19(below age of marriage) and she is abv 18(above legal age of marriage. please help me...I don't have enough time.....and we can't loose each other

Our families knows each other very well..but the problem is she is my real aunty's(wife of my DAD's real younger brother)cousin sister..however i don't think this falls in degree of prohibited relations...As it is a very far away relation.(she is not even her real sister)

Your marriage will not be totally illegal even if you are under 21. I dont know to what religion you belong to. But if you are Hindu, you can marry as per hindu rites. You should inform police by sending letter by RPAD that you are going to marry.

When you are below the age u cannot marry. Before marriage think about the pros and cons, because even if you got married and if her parents lodged complaint both you will be put into unnecessay trouble. Request your gf to take time to decide about her marriage with another guy.

You cannot marry at this age. If it is necessary seek a police help, in support of your girl friend.

Untill you get 21 years old your marriage can't be recognise by law. But same time am little differ from mr.raju's word.. If you got married subsequently the girl's parents made complaint mean your girl friend's statement will save you.. If she say anything against you then only the penal section can apply on you..

If they marry, will their marriage be illegal? The girl is adult and more than 18 yrs. if she voluntarily goes with the boy and marries him, how the boy would come in trouble? I really want experts to enlighten on this.I believe that if parties are hindu, their marriage in the given circumstances can not be called as void or illegal.

Your girlfriend can file police complaint against her parents as they are trying to pressurizing her.
You don't have to do in this situation as your age limit.

At this age you and your girlfriend don't have enough maturity .Better to wait for some period and tell her that if their parent are pressurizing her then you can file criminal complain and then see whether she file fir or not .

Good morning palnitkar sir. Little tom's view on this issue.. Legally no problem to that boy since that girl is major. But their marriage is questionable know? Because both they are 19 years. In case they escaped from house, and got married mean what will be the next step? Her family will file a girl missing or abduction complaint., or they will move a habeas corpus petition before high court. In the situation if the police captured the spouse, and they produced the detenue before the high court mean- there what are the possibilities? She may state that she in love with him, got married etc etc.. Since she is a major her statement is admittable one. Suppose, in the mean time she realised her mistake, or the parents convinced the girl to back home mean? If she stated anything against the boy mean, Automatically the f.i.r Will not be altered? The boy will not go to judicial custody?

i agree with Mr Toms view

I have deliberately suggested to inform the police by regi post. once the girl informs police by regi post her subsequent stand against the boy will not have much value. I also suggested to get married as per hindu rites which involves ceremonies like saptapadi that is to be performed by a brahmin. so you will get some independant witness to say that the marriage was voluntary. The parents may file FIR but the evidence with the boy will save him. Such an FIR is possible even after boy marries after he completes 21 yrs and girl may also turn around at that time. That danger is always there. Age of the boy is hardly relevant for those dangers.Of course I agree with the suggestion that it is better to wait.

Marriage becomes illegal even if one of the partner is below the legal age of marriage. So, better make decision only after weighing pros & cons of the marriage, so that none of you may land in to trouble.
