sir want to know what is the stand over will made for both ancestral and self earned property in india. can a individual make a will of his ancestral property to anyone..........

yes an individual can make a will of his share in the ancestral property.

one can make a will on any property that is ok sir but what is the legal stand weather the will be legally valid over ancestral property or all the legal heirs will get their equal share bypassing the will of and ancestral property............... pls reply thanxxxxxxxx

No it would not be valid if the property does not situate in Bengal or Assam.

Dear Anonymous, One has to see the documents. What you assume to be ancestral may or may not be ancestral. On seeing the complete documents one will be in a position to give an appropriate answer to your query.

sir i have attached the copy of will pls advise the possibilites as i m ready to give away the part of brothers but the way they beheaved with my parents and still not getting ready to get agree for fair distribution of property.. also try ever now and then to implicate me in false cases so that i will get afraid of them... as i m serving in air force (making me fearful of loosing my job whenever i use to visit my home).. mother is staying with me and they behave in ill manner to my mother also..... pls advice ... i m attacing the will and kathoni of harayana land data of delhi land is mentioned in will.... thanxxxxxxx vinod....

You have attached only Nakal Jamabandhi. You have not attached any WILL.

As I suspected, the testator says that he is the absolute owner of the property. Get the WILL registered. Let the witnesses be sound and young so that in future if any need arises for proving the WILL they should be available.

sir the will is registered and my father has expired also one of the witnesses of the will expired... now i m left with one of the witness... i have applied for the mutation of the land and the case is changed into a suit and pending with the S.D.M.....
