Sum1 advised tht proving 494 not valid will hamper my case & 306 will become hard to crack.. Is tht right or wrong?? Please give ur views.. Sum1 needs help badly..

A friend of mine married a
girl (arrange), on 12 dec 14,
but after this he found out
tht she was married to sumone
else in a local mandir in
2011.. My friend registered
the marriage in JAn 2015..
After 3 mnths of registration
da old guy commited
suicide.. His mother filled the
case against both the
husband wife & his wifes jiju..
No suicide note.. Everyone from sikh religion.. Even the mandir is blacklisted

Police did the investigation..
They are behind bars.. His
family have RTI from the
hospital in which he (the guy
who died) was admitted at
1:05 am in the morning.. &
according to her mother in
chargesheet she said he
took poison @6:30 am in the
morning & stated tht just
because of them(my friend &
his wife) he committed it..
Now the additional session
judge rejected bail of wifes
jiju.. He(dead guy) was a drug
addict too..

What way was jiju involved?
Section 494 ipc relates to marrying again during the lifetime of the husband/wife.
Section 306 ipc relates to abetment of suicide.
Can U clarify the above in detail as U say all of them belong to sikh religion.

U said admitted in hospital at 1.05 AM,that would be in the records of the hospital.Hence the statement of the mother that he consumed poison at 6.30AM has no significance.
One thing U failed to clarify is where was the old man staying along with his mother? Still U have not revealed the role played by the JIJU.

No the first marriage was not registered.. Yes he was living with his parents & a brother. He was not involved at all but his mum said tht he was one of them too ( who pressurised him).. The girl & the guy never stayed together after the mandir marriage..

An advocate advised me.. When i was giving proofs of the marriage, like certificate from sikh temple, marriage registration certificate, photos & video of the marriage.. & the palace's bill where the party took place with around 1000 guests..

Whether With Or With Out Registration You Should have Taken Steps to Ensure the Earlier Marriage As Null and Void Legally.Now the things were Messed Up.Better Seek the Guidance of Local good Senior Advocate Or Try an Amicable Settlement with the Parents of the Deceased.

The validity of the second marriage raises eyebrows.I feel something else is involved in the case which the querist is not able to reveal.

whether the earlier marriage was registered or not, it was binding on her and any other marriage is illegal and void.
Anyone having slept with her (whether by illegal marriage or not)is criminally liable at the instance of lawful husband and he has exercised his right.

There is nothing else involved.. Moreover a case was already been in trial for marriage null.. Before 4-5 mnths of the second marriage..@ expert sainath
