Divorce u/s 13b

Hi i am naveen kumar from amritsar punjab i want to take advice from your side i got married on 11-5-2011 our divorce filed u/s 13b and last date of court on 3-jan-13 both me and my wife signed on papers in court twice before 3-jan-13 but last date of court is pending on3-jan-13 i dont want to take her divorce and she also agree with me what can i do now plz give revert as soon as possible

wish both of u very happy new year:

Both of you can appear before court on next date i.e. 3-1-13,
and submit a application to allow you to withdraw the 13b petition.[reason: we are living happily together as h-w, do not want divorce. ]

Any clerk sitting nearby court will prepare this Application for a small sum of Rs. 25-50/- & fix requisite court fees stamp [may be rs. 5/-] and submit in court.
As an alternate, on oral submission, court will send you to mediator/ councillor, who will report that you settled your dispute and willing to lead ur married life together, and petition may be withdrawn. It will work. OK.

Judge will allow this Application, and then peacefully enjoy ur married life. Best of Luck.

You can file a petition in the court asking for dismissal.
You may alternatively stop appearing in the court on the next dates as a result of which the case may get dismissed after some time.

Better both of you jointly move an application for withdrawal of petition u/s 13B of HMA in court on 3.1.2013.Court will allow your application and dismiss the petition of 13B of HMA.

Go to Court on tomorrow at sharp 10 AM and move the already prepared application seeking withdrawal of your divorce petition and happily start your married life again.

There is no legal issue in between.

No permission for withdrawal is required in Punjab & Haryana so directly move application for withdrawal.
