When a person does have a cause of actition and needs to file a suit but does not have money to buy and pay court's fees he files a suit along with an indigency petition where he pleads he has no means to pay court fees and when he proves the same to the court by evidence against the state(to whose exchequer
the court fees has to go),court declares him indigent and allows his suit to proceed without prepayment of court fees.

you are advised to read ORDER XXXIII SUITS BY INDIGENT PERSONS (THE FIRST SCHEDULE)of the Civil Procedure Court.
